Labor Junction Terms of Service
Effective date: November 1, 2026 These terms are an agreement between you and Element Five Solutions, Inc. (“we”,“us”) for your use of the Labor Junction app and service. By creating an account or using Labor Junction, you agree to them.
1. The service
Labor Junction helps home service businesses (“providers”), their crew (“associates”), and homeowners (“customers”) keep track of jobs: appointments, estimates, invoices, payments, time, mileage and expenses, and a homeowner’s home equipment and service history. We provide the tools; we are not a party to the work or the payment arrangements between providers and customers. Labor Junction is a software platform that providers, associates and customers use to manage their work. Providers and Associates are independent contractors and not employees, partners, or agents of Element Five Solutions, Inc. Element Five Solutions, Inc does not control, and has no right to control, the means, methods, or details of the work performed by Providers or Associates.
2. Your account
- You must be at least 18 and give accurate information.
- Keep your password private. You’re responsible for what happens under your account.
- If you sign in with Google or Apple, keep that account secure too. Their own terms apply to that sign-in.
- A provider who adds associates or customers is responsible for having the right to add them and for the access they give them. Customers always choose their own sign-in.
- A provider who signs up a business, or buys a plan for it, must be allowed to do so for that business, and is responsible for removing associates’ access when they leave.
- Connecting with a provider: a provider’s record of you and your own account are joined only when you accept their request or join with their code. Accepting lets you see that provider’s jobs, estimates, bills and visits for you. It does not accept an estimate, authorize a charge, or sign you up for marketing. You can disconnect at any time; the provider keeps their own records.
- You can delete your account at any time in the app (Profile → Account → Delete account). You confirm with your password or a passkey, or by signing in with Google or Apple again if you signed up with them. Deleting your account removes your personal profile, but records you shared with others (such as invoices, estimates, or service history) remain part of those users’ records.
3. Your content
- You own what you put into Labor Junction: notes, photos, documents, estimates and invoices. Nothing in these terms shall be construed to prohibit or restrict your ability to engage in covered communications, such as providing honest reviews or feedback regarding the services or conduct of Element Five Solutions, Inc. or any provider, in accordance with the Consumer Review Fairness Act and applicable law.
- You give us permission to store, process and display it only as needed to run the service for you and the people you work with, as described in our Privacy Policy.
- Don’t upload anything you don’t have the right to share, or anything unlawful.
- Labor Junction itself (the app, its design and its name) is ours. Don’t copy, resell or take it apart, or get around its security or plan limits.
4. Providers and customers
- Estimates and invoices are between the provider and the customer. The provider is responsible for their prices, taxes, licences, permits, insurance and the work itself. For providers meeting certain transaction thresholds, Element Five Solutions, Inc. will collect, verify, and disclose the provider’s business name, physical address, and contact information to customers in accordance with applicable law.
- Payments recorded in the app are a record kept by the provider.
- Online payments are processed by Stripe under the Stripe Services Agreement. The provider is the merchant: they pay Stripe’s fees and handle refunds and disputes with their customers in their own Stripe account.
- Leads from connected services (for example Thumbtack or Angi) are governed by those services’ own terms and fees.
- We don’t check providers’ licences or insurance, and we don’t guarantee the quality, safety or legality of any provider’s work, or that a customer will pay. Disagreements about the work, prices, warranties or refunds are between the provider and the customer.
5. Your home’s records
Homeowners can keep records of their homes and equipment. A provider sees a home’s equipment only when the homeowner shares that home with them, and can then record the service they do. You’re responsible for having the right to add someone else’s information. Home records are a convenience, not a replacement for a professional inspection or your own copies of important documents.
6. Location and reminders
Visit location notes and Arrival reminders depend on your phone’s location services and can be wrong or late. They’re a convenience; check times and records before approving or billing them.
7. AI features
Some features suggest content using an AI service, for example reading a receipt or drafting estimate lines. Suggestions can be wrong. Review them before saving or sending, and don’t rely on them as professional, legal or safety advice.
8. Acceptable use
Don’t misuse Labor Junction. That includes trying to reach other people’s information, interfering with the service, sending spam, or using it for anything unlawful. We may suspend accounts that do.
9. Plans and billing
Labor Junction is free for homeowners and associates. Providers can use the Free plan, or a paid plan: Pro at $29 a month, or Crew at $79 a month with 15 associates included and $5 a month for each associate after that. The plan comparison shows each plan’s limits; the checkout page shows the price, any tax, and any promotion, and that’s what you’re charged.
- Paid plans are bought and managed on the Labor Junction website, not through the App Store or Google Play. Stripe handles the payment.
- They renew every month until you cancel. You can change your card, switch plans or cancel any time from the billing page, or with Cancel plan.
- Upgrading takes effect right away, with the difference charged for the rest of the month. Downgrading or cancelling takes effect at the end of the month you’ve paid for.
- Unless the law says otherwise, or checkout says so, we don’t refund part of a month.
- If a renewal payment fails, we try again; after seven days the account moves to the Free plan. Nothing is deleted, but the Free plan’s limits apply to new jobs and associates.
- We’ll provide at least 30 days notice before we change a price.
For services performed in Minnesota, Element Five Solutions, Inc. will collect and remit sales tax per Minn. Stat. Section 297A.61. Your subscription will automatically renew monthly at the then-current rate unless cancelled. You will be charged recurring monthly fees until you cancel. You may cancel at any time with the Cancel plan button (Your account → Plan & usage) to avoid future charges. Element Five Solutions, Inc. will provide annual renewal notices as required by Minnesota law.
10. Text messages
Program: Labor Junction job notifications. If you agree to texts in the app, we text your mobile number about your jobs with the businesses you work with: visit reminders and “on the way” notices, estimates, invoices, contracts and payment receipts. Texts name the business they come from. Agreeing is not a condition of using Labor Junction or of buying anything.
How often: message frequency varies with your jobs.
Costs: message and data rates may apply. Your mobile carrier’s plan sets them.
Stopping: reply STOP to any text to stop all texts. We’ll confirm, and send nothing more unless you reply START or turn texts back on in the app. You can also turn texts off in your contact preference at any time.
Help: reply HELP, or email info@e5sol.com.
Carriers aren’t liable for delayed or undelivered messages. See our Privacy Policy for how we handle your number.
11. Changes and availability
We may change or stop features. We will provide at least 30 days notice of material changes to these terms by email or through a notice in the app. We aim to keep the service available but can’t promise it will always be uninterrupted or error-free. Services we rely on, such as Stripe, app stores and map and messaging services, have their own terms and can have outages we don’t control.
12. Disclaimers and limits
LABOR JUNCTION IS PROVIDED AS IS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, Element Five Solutions, Inc DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. NOTHING IN THESE TERMS EXCLUDES LIABILITY FOR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT. SUBJECT TO THE FOREGOING, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO US $100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, WHICHEVER IS GREATER. WE ARE NOT LIABLE FOR INDIRECT OR CONSEQUENTIAL LOSSES.
13. Indemnification
You agree to indemnify and hold harmless Element Five Solutions, Inc and its officers, directors, and employees from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with (a) your access to or use of the Service; (b) your violation of these Terms; or (c) any dispute between a Provider and a Customer or Associate.
14. Ending
You can stop using Labor Junction and delete your account at any time. We may suspend or close accounts that break these terms. Sections 3, 4, 9 (for anything owed), 12, 13 and 15 continue after an account ends.
15. Law
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.
Informal Dispute Resolution. If you have any issue or problem with us, please email info@e5sol.com first, and we will attempt to resolve it informally before taking any legal steps.
(a) Arbitration. You and Element Five Solutions, Inc. agree that any dispute, claim, or controversy arising out of or relating to these Terms shall be settled by binding individual arbitration administered by the American Arbitration Association (AAA). The arbitrator shall have exclusive authority to resolve any dispute regarding the interpretation, applicability, or enforceability of this binding arbitration agreement.
(b) Class Action Waiver. YOU AND ELEMENT FIVE SOLUTIONS, INC. AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING, EXCEPT AS PROVIDED UNDER THE ENDING FORCED ARBITRATION OF SEXUAL ASSAULT AND SEXUAL HARASSMENT ACT.
Governing Law and Jurisdiction. These Terms are governed by the laws of the State of Minnesota, except where your local law grants you rights that cannot be waived. Subject to the arbitration provisions above, and except for claims involving sexual assault or sexual harassment, which may be brought in court at the claimant’s election as provided by the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act, any legal action or proceeding arising under or relating to these Terms shall be brought exclusively in the state or federal courts located in Minnesota, and each party hereby consents to the personal jurisdiction of those courts.
